Terms of Service

These Terms of Service (the "Terms") set forth the conditions for using the DuraRing application (the "App") provided by LDW ("we," "our," or "us"). By using the App, you agree to be bound by these Terms.

Article 1 (Application)

1. These Terms shall govern the conditions for providing the App and the rights and obligations between users and us regarding the use of the App, and shall apply to all relationships between users and us regarding the use of the App.
2. In the event of any discrepancy between these Terms and the rules other than these Terms or other explanations of the Service, the provisions of these Terms shall prevail.

Article 2 (Definitions)

The following terms used in these Terms shall have the meanings set forth below:

1. "App" means the application named "DuraRing" provided by us (including the service after such changes, regardless of the reason for the change of the service name or content).
2. "User" means all persons who use the App after agreeing to these Terms.
3. "Registration Information" means the information provided by users to us in connection with the use of the App.
4. "Content" means text, images, videos, and other information that users upload, post, or otherwise transmit through the App.

Article 3 (Account Registration)

1. Account registration is required to use some features of the App.
2. Applicants for registration shall apply for registration in the manner prescribed by us after agreeing to these Terms.
3. Applicants for registration must provide us with true, accurate, and up-to-date information when applying for registration.
4. Users shall promptly update their registration information if there are any changes to it.

Article 4 (Account Management)

1. Users shall appropriately manage their account information for the App at their own responsibility.
2. Users may not, under any circumstances, transfer or lend their account information to a third party.
3. We shall deem the use of account information to be the use by the user himself/herself if the combination of account information matches the registration information and is logged in.

Article 5 (Services Provided)

The App provides the following features:

• OCR feature
• Image capture feature
• AI dictionary feature
• AI image feature
• Memorable phrases feature (linked with books & highlights)
• Reading, furigana, and Hangul pronunciation features
• Register books via barcode (book management)
• Bookmark words feature
• Mission system
• Points system
• Login feature

Article 6 (Usage Fees)

1. The basic features of the App are provided free of charge.
2. The use of some features (such as AI features) may require the consumption of points or payment.
3. When using features that incur charges, users shall check the fees in advance before using them.
4. Fees once paid will not be refunded, except in cases where we are at fault.

Article 7 (Prohibited Acts)

Users shall not engage in the following acts when using the App:

1. Acts that violate laws or public order and morals
2. Acts related to criminal activity
3. Acts that infringe on the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of us, other users of the App, or third parties
4. Acts that place an excessive load on the network or system of the App
5. Acts that may interfere with the operation of the App
6. Acts of unauthorized access or attempts to do so
7. Acts of collecting or accumulating personal information about other users
8. Acts of using the App for fraudulent purposes
9. Acts that cause disadvantages, damages, or discomfort to other users of the App or other third parties
10. Acts of impersonating other users
11. Advertising, soliciting, or business activities on the App that are not authorized by us
12. Acts of fraudulently using the features of the App
13. Acts of scanning or sharing copyrighted books without permission
14. Other acts that we deem inappropriate

Article 8 (Suspension of the App)

1. We may suspend or discontinue all or part of the App without prior notice to users if any of the following applies:
   • When performing inspection or maintenance of the computer system related to the App
   • When the App cannot be operated due to failures, malfunctions, excessive access concentration, unauthorized access, hacking, etc. of computers, communication lines, etc.
   • When the App cannot be operated due to force majeure such as earthquakes, lightning, fires, floods, power outages, or natural disasters
   • When we deem suspension or discontinuation necessary
2. We shall not be liable for any damages caused to users by measures taken by us pursuant to this Article.

Article 9 (Attribution of Rights)

1. All intellectual property rights related to the App belong to us or to those who have licensed us, and the permission to use the App under these Terms does not mean permission to use the intellectual property rights related to the App belonging to us or those who have licensed us.
2. Users represent and warrant to us that they have the lawful right to post or otherwise transmit the content they have posted, and that such content does not infringe on the rights of third parties.

Article 10 (Restriction on Use and Deletion of Registration)

1. We may, without prior notice to users, restrict all or part of the use of the App or delete the registration as a user if the user falls under any of the following:
   • If the user violates any provision of these Terms
   • If it is found that there are false facts in the registration information
   • If the credit card registered as a payment method becomes invalid
   • If there is default in payment of fees
   • If there is no response to contact from us for a considerable period of time
   • If there has been no use of the App for a considerable period from the last use
   • If we otherwise determine that the use of the App is not appropriate
2. We shall not be liable for any damages caused to users by actions taken by us pursuant to this Article.

Article 11 (Withdrawal)

1. Users may withdraw from the App by following the procedures prescribed by us.
2. After withdrawal, account information and saved data will be deleted and cannot be restored.
3. If there are unused points at the time of withdrawal, they will all expire and will not be refunded.

Article 12 (Disclaimer and Limitation of Liability)

1. We do not guarantee, either explicitly or implicitly, that the App is free from de facto or legal defects (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors or bugs, infringement of rights, etc.).
2. We make no warranties regarding the accuracy, completeness, usefulness, reliability, etc. of the information provided through the App.
3. We shall not be liable for any damages caused to users due to the App, except in cases of our willful misconduct or gross negligence.
4. The accuracy of text recognition results by the OCR function of the App is not guaranteed. Users must verify the recognition results.
5. We shall not be liable for any damages caused by the use of information acquired by users through the App.

Article 13 (Changes to Service Content)

We may change, add, or abolish the content of the App with prior notice to users, and users agree to this.

Article 14 (Changes to Terms of Service)

1. We may change these Terms at any time without notice to users if we deem it necessary.
2. The revised Terms shall become effective from the time they are posted within the App.
3. If a user starts using the App after these Terms have been changed, the user shall be deemed to have agreed to the revised Terms.

Article 15 (Handling of Personal Information)

Personal information acquired through the use of the App shall be handled appropriately in accordance with our "Privacy Policy."

In addition, to provide AI dictionary and related features, we may transmit input text and other minimum necessary data to third-party AI services such as OpenAI, Google Gemini, and Perplexity. For details, please refer to Section 3 (Third-Party Services) of the Privacy Policy.

Article 16 (Notices and Communication)

Notices or communications between users and us shall be made in the manner prescribed by us. Unless we receive a change notification from the user in the format separately prescribed by us, we shall deem the currently registered contact information to be valid and shall send notices or communications to such contact information, which shall be deemed to have reached the user at the time of transmission.

Article 17 (Prohibition of Assignment of Rights and Obligations)

Users may not transfer or pledge their position under the usage contract or their rights or obligations under these Terms to a third party without our prior written consent.

Article 18 (Jurisdiction)

In the event of any dispute arising in connection with this app, the court with jurisdiction over the user's place of residence shall have exclusive jurisdiction as the court of first instance, provided that the user's place of residence is in Japan or the Republic of Korea.
